Welcome to Pathfinder Maritime Training. Please read these Terms of Service (“Terms”) carefully before using our website (pathfindercaptain.com) and our mobile application (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
Pathfinder Maritime Training provides USCG-approved maritime training courses and educational materials. Some services are provided via our website, while others are accessible through our mobile application.
2. Accounts
To access our courses, you must create an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old or have legal parental/guardian consent to use our Service.
3. In-App Purchases (IAP)
Our mobile application offers digital content and courses (e.g., “Lifeboatman”) for purchase.
- Transaction Processing: All In-App Purchases are processed through the Apple App Store. By making a purchase, you agree to Apple’s Media Services Terms and Conditions.
- Non-Consumable Content: Courses are “Non-Consumable” purchases. Once purchased, the content does not expire and will remain associated with your Apple ID.
- Restoring Purchases: If you switch devices or reinstall the app, you may use the “Restore Purchases” button within the app settings to regain access to your purchased courses at no additional cost.
- Refunds: All financial transactions for In-App Purchases are handled by Apple. Pathfinder Maritime Training is unable to process refunds for In-App Purchases. To request a refund, you must contact Apple Support directly.
4. Website Purchases
Purchases made directly through our website are processed via third-party providers (e.g., Shopify). Refund requests for website-direct purchases are subject to our internal refund policy and must be submitted to info@pathfindercaptain.com.
5. Intellectual Property & License
All course materials, videos, and exam prep content are the property of Pathfinder Maritime Training. When you purchase a course, we grant you a limited, non-exclusive, non-transferable license to view the content for personal, educational purposes. You may not:
- Share your account credentials with others.
- Record, copy, or redistribute course content.
- Use the content for commercial purposes without written consent.
6. Maritime Regulatory Compliance
While our courses are designed to help you meet USCG requirements, the final granting of any maritime license or endorsement is at the sole discretion of the U.S. Coast Guard and the National Maritime Center. We are not responsible for applications rejected due to external factors (e.g., medical issues, sea time discrepancies).
7. Limitation of Liability
Pathfinder Maritime Training shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service. Our total liability for any claim shall not exceed the amount paid by you for the specific course in question.
8. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Service after changes constitutes acceptance of the new Terms.
